Seal Strong VA, LLC – 25-Year Limited Product Guarantee
1. Guarantee Coverage
Seal Strong VA, LLC (“Seal Strong,” “we,” or “us”) hereby provides this 25-Year Limited Product Guarantee (“Guarantee”) for its sealant products (“Product”), when applied strictly in accordance with Seal Strong’s written instructions, technical specifications, preparation requirements, and product labels.
2. Guarantee Obligation
Subject to the terms and limitations set forth herein, if the Product fails to perform as specified due to a defect in the Product itself, Seal Strong’s sole and exclusive obligation shall be to supply, at no cost to the property owner, replacement Product in an amount not to exceed the volume originally purchased and applied. Labor, application services, equipment, and all other associated costs are expressly excluded from this Guarantee.
3. Conditions of Coverage
This Guarantee applies when the Product was applied to an eligible surface (including, but not limited to, wood or concrete) in accordance with the Product manufacturer’s written application requirements.
4. Exclusions
This Guarantee does not cover, and Seal Strong VA, LLC shall not be liable for, any of the following:
a. Damage arising from structural failures, natural disasters, fire, flooding, excessive moisture intrusion, mold, mildew, erosion, soil movement, settlement, or abnormal environmental conditions.
b. Product applications performed by a provider or application not certified by the Product manufacturer.
c. Any incidental, consequential, indirect, special, or economic damages, including but not limited to property damage, personal injury, lost profits, or loss of use.
5. Disclaimer of Other Warranties
Except where prohibited by applicable law, all other warranties—express or implied—are disclaimed, including, without limitation, implied warranties of merchantability, fitness for a particular purpose, and warranties arising from course of dealing or usage of trade.
6. Transferability
This Guarantee is transferable to a subsequent property owner provided that Seal Strong VA, LLC is notified in writing within 45 days of the change of ownership. Failure to register the transfer voids the Guarantee for the new owner.
7. Duration
This Guarantee is valid for twenty-five (25) years from the date of original Product application.
8. Limitation of Liability
Seal Strong’s liability is strictly limited to replacement of the Product as stated above. Seal Strong shall have no obligation for removal, reapplication, repair, inspection, travel, or labor costs of any kind.
9. Claims Procedure
To file a claim, the property owner must:
a. Notify Seal Strong VA, LLC in writing within thirty (30) days of discovering the alleged defect;
b. Provide proof of purchase, date of application, and documentation of the installation conditions; and
c. Allow Seal Strong reasonable access to inspect the affected area prior to any alteration or repair.
Claims not submitted in accordance with these requirements may be denied.
10. Rights Under State Law
This Guarantee provides specific legal rights. The property owner may also have additional rights that vary from state to state. Some states do not allow limitations on implied warranties or exclusion of incidental or consequential damages; therefore, the above limitations may not apply in certain jurisdictions.
